This policy sets rules everyone must follow when using Engicell's network, products, and infrastructure services. It protects our customers, our carriers, the public, and the long-term reliability of the platforms we operate. It is part of, and incorporated by reference into, our Terms of Service and customer MSAs.
Purpose
We host messaging and telemetry traffic for businesses worldwide. Abuse — spam, fraud, unlawful content, security attacks — degrades the service for everyone and exposes carriers and customers to liability. We take it seriously and act quickly.
Prohibited use
You may not use any Engicell service to:
- Violate any applicable law, regulation, sanction, or third-party right.
- Send, host, or facilitate content that is unlawful, defamatory, infringing, obscene, or that depicts the sexual exploitation of minors (CSAM).
- Engage in or support fraud, phishing, identity theft, pyramid schemes, or unauthorised collection of personal data.
- Distribute malware, ransomware, spyware, or other malicious code.
- Probe, scan, or test the vulnerability of any system or network without authorisation.
- Circumvent authentication, rate limits, or access controls of any system.
- Engage in cryptocurrency mining or proof-of-work on shared infrastructure without prior written consent.
- Misrepresent identity, origin, or affiliation, including sender-ID spoofing.
- Interfere with the integrity, performance, or availability of the service for others.
Messaging (SMS)
If you use any Engicell messaging product or application, you must additionally:
- Have lawful consent from each recipient before sending — express prior consent where the law requires it (e.g. TCPA, ePrivacy, India TRAI TCCCPR, Australian Spam Act).
- Honour opt-out requests immediately and irrevocably, including standard keywords such as STOP, UNSUBSCRIBE, and their local-language equivalents.
- Identify yourself clearly as the sender; do not impersonate brands you do not own or operate.
- Comply with the rules of every destination country and carrier, including registration, content, and throughput requirements (e.g. 10DLC in the US, sender-ID registration in India and the UAE).
- Never send to recipients on a national do-not-call/text registry that prohibits your traffic type.
- Never use the service for one-time-password (OTP) traffic into a country that requires a registered template you do not hold.
We may rate-limit, filter, or refuse any message that we reasonably believe violates this section, and we may share traffic data with carriers and regulators on lawful request.
Tracking (GPS)
If you use any Engicell tracking or telemetry product or application, you must additionally:
- Track only assets and individuals you have a lawful basis to track. For employees, ensure tracking is disclosed in writing and limited to work hours or work-owned vehicles where required by local law.
- Not use the service to stalk, harass, or covertly monitor any person.
- Configure retention and access controls consistent with your obligations under applicable privacy law.
Security
- Protect your credentials and API keys. Rotate them on personnel changes.
- Report suspected vulnerabilities to info@engicell.com; do not test our systems beyond what is necessary to demonstrate the issue.
- Do not export, re-host, or resell raw access to our APIs without a written reseller agreement.
Fair use & capacity
Where a plan is described as "unlimited" or has no published quota, it remains subject to fair use: spikes that are an order of magnitude above your trailing 30-day baseline, or that materially degrade service for other customers, may be throttled until we can review them with you and upgrade capacity. We will not throttle without notification except in an active abuse or incident-response scenario.
Enforcement
If we conclude (in our reasonable judgement) that this policy has been breached we may, in proportion to the breach:
- Notify you and ask you to remediate within a defined window.
- Throttle, filter, or block specific traffic.
- Suspend the account.
- Terminate the contract for material breach.
- Cooperate with carriers, regulators, and law enforcement, including disclosure where lawful.
For activities that present an immediate risk to the service, recipients, or the public (e.g. ongoing spam runs, CSAM, active attacks), we may suspend without prior notice and notify you as soon as practicable.
Reporting abuse
Send abuse reports to info@engicell.com. Include the offending message ID or asset ID, timestamp, your role, and any supporting evidence. We acknowledge reports within one business day and investigate within five.
Changes
We may update this policy as threats and regulations evolve. Material changes will be posted with at least 14 days' notice on this page; immediate updates may apply where a regulator or carrier mandates a faster change.
